This is our third, and for the moment your final Hearsay course in this series. If you've made it this far you know you're going to enjoy Hearsay 103. With Hearsay 103 we continue our review of the Hearsay exceptions as set forth in Rule 803(3) thru (6). Thus you'll be dealing with: then existing mental, emotional, or physical condition; statements for purposes of medical diagnosis or treatment; recorded recollection; and, records of regularly conducted activity. Now if you remember all you ever learned in law school and have kept up with all the changes in the rules then you won't learn much but you will have fun testing your knowledge. As always a review of the Rules of Evidence requires an inquiry into other Rules of Evidence is a necessity. So you'll also review Rule 703. "Bases of Opinion Testimony by Experts" and, Rule 403 "Exclusion of Relevant Evidence on Grounds of Prejudice, Confusion, or Waste of Time", along with a few others.
